In order to comply with Clery Act requirements, colleges and universities must understand what the law entails, where their responsibilities lie, and what they can do to actively foster campus safety. |

LAWS REGULATING EDUCATION AND MEDICAL INFORMATION PRIVACY
The work of healthcare providers, school personnel, and others interacts with FERPA and HIPAA frequently,
which is why it is important to understand these laws and know when they apply. |
Family Educational Rights and Privacy Act of 1974 (FERPA)
This is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education. You cannot share student-specific information with anyone except for the student themselves, your supervisors, or emergency personnel. |
Health Insurance Portability and Accountability Act of 1996 (HIPAA)
This is a federal law that required the creation of national standards to protect sensitive patient health information from being disclosed without the patient’s consent or knowledge. The US Department of Health and Human Services (HHS) issued the HIPAA Privacy Rule to implement the requirements of HIPAA. The HIPAA Security Rule protects a subset of information covered by the Privacy Rule. |
